What is an ADU?

Are ADUs Allowed in Modesto? 

Yes, under California state laws, SB 13 and AB 68, the City of Modesto must allow ADUs on any lot zoned for residential use. 

California has basic state standards for ADUs. If an ADU meets the following criteria, it must be approved by the city:

  • 800 square feet or less
  • 16 feet or less in height, 
  • 4-foot side and rear setbacks 

Modesto typically allows ADUs up to 1,200 sq. ft. if detached, or 50% of the primary dwelling’s size if it’s attached, whichever is smaller. State law often protects units up to 800 sq. ft. regardless of lot coverage.

Home styles in Modesto vary — the most popular styles are midcentury modern, craftsman and bungalow, Mediterranean and Spanish Colonial Revival, ranch, and Victorian homes.

Recently, modern farmhouses have been a trending new style for new homes, including ADUs. Key features include board-and-batten siding, classic black window frames, and gabled roofs. 

Popular ADU styles include modern farmhouses to match new construction. Modern style ADUs with a shed roof are also popular for mid-century properties. Stucco ADUs mesh well with the Mediterranean and Spanish style.

What is the Permitting Process for ADUs in Modesto? 

Every municipality has a permitting process for ADU builds. Most of them follow a similar process that begins with reviewing architectural drawings and plans. You’ll also have fees based on size. 

Plan Review: Submit a site plan to the Modesto Planning Division to ensure setback compliance. 

Building Permits: Requires detailed architectural, structural, and Title 24 (energy efficiency) plans.

Fees: Modesto has reduced “impact fees” for ADUs. Specifically:

  • ADUs under 750 sq. ft. are exempt from most impact fees.
  • ADUs over 750 sq. ft. are charged impact fees proportional to the size of the primary dwelling.

California law requires cities to act on ADU applications within 60 days of a completed submission.
